ClutchKing Terms of Service

1. Introduction

Welcome to ClutchKing. These Terms of Service govern your access to and use of our fantasy product, including free experiences, paid leagues, wallet features, and related services.

2. Acceptance of Terms

By creating an account, accessing ClutchKing, or participating in any league, event, or wallet flow, you agree to these Terms and to any league-specific rules, prize descriptions, or policies made available through the platform.

3. Eligibility

• Age Requirement: ClutchKing may offer free-to-play experiences according to applicable law. Participation in paid leagues and wallet transactions is restricted to users who are 18 years of age or older and legally permitted to participate under applicable Brazilian law.
• Verification and Wallet Access: ClutchKing may require identity, CPF, date of birth, PIX, region, or other verification information before allowing a user to activate a wallet, enter a paid league, receive prizes, or request withdrawals.
• Account Registration: To create an account and participate in ClutchKing, users must provide valid and current information, including a valid email address.
• Responsibility: By using ClutchKing, you are responsible for your activity on the platform. If you use ClutchKing on behalf of a legal entity, you represent that you have authority to bind that entity to these Terms.
• Compliance with Laws: You must use ClutchKing in compliance with all applicable local, state, national, and international laws, rules, and regulations.
• Prohibited Users: Individuals who have been suspended, removed, or otherwise restricted by ClutchKing are not eligible to use the service unless expressly reinstated.
• Geographic Restrictions: ClutchKing may limit or deny access to paid leagues, wallet features, or other services in countries, states, or regions where operation is restricted, unavailable, or not supported.

4. Account Registration

• Requirements for Registration: To participate in ClutchKing, users must register an account and provide accurate and current information, including a valid email address, a unique username, and a team name. Team names are not exclusive and may be used by multiple users.
• Optional Information - Favorite Team: During account registration, users may optionally select a favorite Counter-Strike team. This information may be used to personalize the user experience and for marketing purposes. Users may change this selection through their account settings.
• Responsibility for Account Information: Users are responsible for maintaining the confidentiality of their account information, including their password, and for all activity that occurs under their account. Users agree to notify ClutchKing immediately of any unauthorized use or security breach.
• Updating Account Information: Users are responsible for keeping their account information, including their email address, accurate and up to date. ClutchKing is not responsible for issues caused by outdated or incorrect account information.
• Acceptance of Terms: By completing registration, users confirm that the information they provide is truthful and accurate to the best of their knowledge and that they agree to comply with these Terms.

5. User Conduct and Prohibited Actions

• General Conduct: Users must behave lawfully and fairly. Prohibited conduct includes abuse, harassment, bullying, impersonation, spam, unauthorized advertising, intellectual property infringement, hacking, distribution of malicious software, exploiting bugs, false reporting, misuse of third-party personal information, and any illegal activity.
• Cheating, Fraud, and Integrity Violations: Users may not use bots, scripts, unauthorized software, multiple accounts, collusion, match manipulation, payment abuse, chargeback abuse, or any other scheme intended to gain an unfair advantage or interfere with league integrity, wallet operations, or prize allocation.
• Record of Prohibition: If a user is prohibited or banned for violating these Terms, ClutchKing may retain a minimal record of the violation, including the user's identifier and the reason for the restriction, in order to enforce these Terms, protect platform integrity, and prevent circumvention.

Such records will be processed and retained in accordance with applicable data protection laws and principles, particularly those related to data minimization and purpose limitation.

Users who have been prohibited from using the service and have had their personal data erased may be denied re-registration based on this retained record.

6. User-Generated Content and Team Names

Users retain ownership rights over their user-generated content. However, by creating content within ClutchKing, users grant ClutchKing a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, modify, publish, and display that content for purposes related to the service and its promotion. This license continues even if the user stops using the service or deletes the account.

7. Gameplay, Paid Leagues, and Events

• Skill-Based Fantasy Contests: Paid leagues on ClutchKing are offered as fantasy contests based principally on skill. Results depend on user knowledge, roster and lineup decisions, transfer decisions, and the published scoring rules applicable to the relevant event or league, and not solely on chance.
• League Rules and Entry: Before a user enters a paid league, ClutchKing may disclose the buy-in amount, prize structure, eligibility requirements, entry deadline, review process, and any special league rules. By entering, the user agrees to the rules published for that paid league in addition to these Terms.
• Wallet, Buy-Ins, and Prizes: Paid league participation may require an active and verified wallet. Buy-ins may be reserved, captured, released, refunded, or otherwise adjusted through the wallet according to the applicable league rules, event status, integrity reviews, payment status, and these Terms. Prize amounts, if any, may be credited to a user's wallet and may be subject to verification or review before withdrawal.
• Scoring, Corrections, and Finality: Scores and rankings may rely on official event data, third-party data feeds, and ClutchKing's scoring rules. ClutchKing may correct scores, rankings, standings, entries, or prize allocations to address stat corrections, data delays, operational issues, technical problems, obvious mistakes, or integrity concerns. Results become final when ClutchKing closes the applicable review process or otherwise marks the relevant league or event as final.
• Fair Play and Integrity: Users must participate fairly and may not attempt to manipulate scoring, rankings, prizes, or league outcomes. ClutchKing may investigate suspicious activity and may suspend participation, hold balances, or restrict access while a review is pending.
• Changes, Cancellation, and Voiding: ClutchKing may modify, suspend, cancel, postpone, discontinue, or restart any event, paid league, entry window, rule set, prize structure, or wallet-related settlement for operational, technical, integrity, event-related, commercial, or legal reasons. ClutchKing may reject, cancel, void, reverse, or adjust any entry, buy-in, refund, prize, or withdrawal where there is fraud, collusion, multiple-account abuse, payment irregularity, chargeback risk, verification failure, technical error, obvious mistake, event cancellation or postponement, or a legal or compliance requirement.
• No Gambling Offering: ClutchKing does not offer paid leagues as casino games, betting products, or wagers on the outcome of a single real-world match. Entry fees, wallet balances, and prize flows are governed solely by these Terms and the rules disclosed for the applicable league.
• User-Created Leagues: Unless ClutchKing expressly identifies a league as eligible for official paid-league wallet or prize features, user-created leagues and competitions are for entertainment purposes only. The creator of each user-created league is responsible for its content, management, and disputes, and ClutchKing is not liable for claims arising from such leagues.

8. Service Interruptions

ClutchKing may interrupt, suspend, or cancel the service, any event, or any paid league due to maintenance, technical issues, third-party outages, integrity reviews, force majeure, or other unforeseen circumstances. Where appropriate, ClutchKing may release reserved buy-ins, issue refunds, or adjust results and prizes in accordance with the applicable rules and these Terms.

9. Dispute Resolution

• In the event of a dispute, users are encouraged to first contact ClutchKing customer support for resolution.
• If the dispute cannot be resolved internally, it will be settled by binding arbitration conducted online under Brazilian law.
• Claims must be filed within one year.
• Users agree to bring claims only on an individual basis and not as part of any class action or collective proceeding.
• ClutchKing's liability is limited to the fullest extent permitted by applicable law.
• Users agree to indemnify ClutchKing against claims, damages, and expenses arising from their use of the service or violation of these Terms.
• All disputes will be governed by Brazilian law.

10. Intellectual Property Rights

All content on ClutchKing, including text, graphics, interfaces, and logos, is the property of ClutchKing or its licensors and is protected by applicable intellectual property laws.

11. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied.

12. Limitation of Liability

ClutchKing is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, to the maximum extent permitted by law.

13. Updates and Maintenance

ClutchKing may perform maintenance, updates, or security measures that temporarily affect availability, scoring, wallet functions, or other service features. ClutchKing is not liable for disruption caused by such maintenance.

14. Termination of Accounts

• Right to Terminate: ClutchKing may suspend, limit, or terminate a user's account, wallet access, or participation in any league or event at any time, with or without notice, if ClutchKing believes the user's conduct violates these Terms, threatens platform integrity, or creates risk for ClutchKing, other users, or third parties.
• Reasons for Termination: Reasons may include repeated violations of these Terms, cheating, fraud, collusion, multiple-account abuse, illegal activity, payment abuse, chargeback activity, verification failure, or providing false or misleading information during registration or use of the service.
• Process of Termination: In the event of termination, ClutchKing may notify the user using the email address provided at registration, when appropriate. Access to certain data or funds may be delayed or restricted while reviews, legal requirements, or payment investigations remain pending.
• Effect of Termination: Upon termination, rights granted under these Terms immediately cease. ClutchKing may cancel entries, void prizes, reverse wallet adjustments, or maintain holds where reasonably necessary to enforce these Terms or satisfy legal, payment, or integrity obligations.
• Appeal Process: If a user believes a restriction or termination was applied in error, the user may contact ClutchKing at support@clutchking.com.br. ClutchKing will review the request within a reasonable time.
• Account Deactivation by User: Users may request deactivation of their account at any time, subject to open reviews, payment obligations, and applicable retention requirements.

15. Links to Other Websites

• External Links: ClutchKing may contain links to third-party websites or services not owned or controlled by ClutchKing. These links are provided for convenience only.
• No Endorsement: The inclusion of a link does not imply endorsement, sponsorship, or recommendation of the third-party website, content, services, or practices.
• Disclaimer of Responsibility: ClutchKing has no control over, and assumes no responsibility for, the content, privacy policies, or practices of third-party websites or services.
• User Discretion Advised: Users should read the terms and privacy policies of any third-party websites they visit.

16. Changes to the Service

ClutchKing may modify, limit, suspend, discontinue, or relaunch the service, any feature, any paid-league format, any wallet flow, or any prize structure at any time, especially for operational, technical, integrity, business, or legal reasons.

17. Governing Law

These Terms are governed by the laws of Brazil.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

19. Entire Agreement

These Terms constitute the entire agreement between the user and ClutchKing regarding the use of the service, except for supplemental league rules, prize descriptions, or policies expressly incorporated by reference.

20. Amendments to Terms

• Notification of Changes: ClutchKing may revise these Terms from time to time. When significant changes are made, ClutchKing may notify users by email, in-product notice, or other reasonable means.
• Effective Date of Changes: Revised Terms become effective when posted on the website or at the time stated in the notice.
• User Responsibility: Users are encouraged to review these Terms periodically. Continued use of ClutchKing after revised Terms take effect constitutes acceptance of the changes.
• Email Responsibility: Users are responsible for maintaining a valid and up-to-date email address if they wish to receive direct notices.
