1. Scope and supplier
These Terms govern ClutchKing accounts, free fantasy experiences, paid leagues, Wingman, wallets, prizes, and related services. The operator's legal name, CNPJ, business address, website, and support contact are displayed in the Supplier identification section below. They must be available before any paid experience is offered.
2. Contract formation and access
You must be able to read these Terms and the material rules of a paid experience before submitting an entry. ClutchKing displays a contract summary and asks for express acceptance when required. A confirmed entry records the applicable Terms and rules versions. You may save or revisit those versions. Material changes apply prospectively and require a new express acceptance; they do not rewrite an already confirmed entry.
3. Eligibility
- Paid experiences and wallet transactions are limited to people aged 18 or older who are legally eligible in Brazil.
- An active, verified personal wallet and accurate identity, CPF, date-of-birth, country, and contact details may be required.
- Availability may be restricted by location, account status, verification, law, or operational readiness.
- One person may not use multiple accounts or another person's identity to gain an advantage.
4. Accounts and security
Provide accurate information, protect your credentials, and promptly report unauthorized access. You are responsible for activity you authorize, but this does not remove rights or protections that applicable consumer law gives you. Keep your email and profile information current.
5. Fair play and prohibited conduct
Bots, scripts, collusion, match manipulation, multiple-account abuse, payment or chargeback abuse, exploitation of errors, unauthorized access, harassment, impersonation, malicious software, intellectual-property infringement, and illegal activity are prohibited. ClutchKing may investigate credible integrity or security concerns and retain the minimum records needed to enforce restrictions, subject to applicable data-protection law.
6. User content
You retain ownership of content you create. You grant ClutchKing a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, and display it only as reasonably needed to operate, secure, improve, and promote the service. The license ends when the content is deleted, except for lawful retention, backups, evidence of violations, or materials already used with your permission.
7. Skill-based fantasy and paid leagues
- Results are principally determined by participants' CS2 knowledge, statistical analysis, roster or lineup decisions, and strategy under preset scoring rules.
- Before a paid-league entry, ClutchKing displays the entry amount, any fee included in the price, minimum and maximum members, entry deadline, prize structure, and cancellation or refund conditions.
- In the current guaranteed official cash-league format, the entry is R$ 10, including a 20% administrative fee (R$ 2), with a maximum of 10 paid members. With at least 5 paid members, guaranteed prizes are R$ 50, R$ 20, and R$ 10 for places 1–3. They remain the same with 5 through 10 paid members. If the minimum is not reached, the league is cancelled, every entry is fully refunded, and no administrative fee is retained.
- Other paid leagues follow the values and rules shown for that league. Guaranteed prizes do not vary with ordinary participation once the stated minimum is reached.
- Entry amounts may be reserved, captured, released, or refunded through the wallet. Prizes are credited to the wallet and withdrawals may require identity, destination, and integrity review.
8. Wingman rules
- Nature of the challenge: Wingman is a skill-based fantasy CS2 challenge under preset rules. Each lineup combines two real players from the same event, different teams, and different matches. Its outcome is not based on one person's performance alone.
- The Analyst: “The Analyst” is a fictional ClutchKing product character representing projections created through historical statistics, scoring models, and operational review. The Analyst is not a real person, your legal counterparty, an opponent, or one of your selected players, and has no discretion over settlement.
- Your decisions: Select exactly two compatible player lines and choose More or Less for each. Use the published scoring chart, player roles, form, and matchup information to make your own analysis.
- Winning: Both picks must be correct. “More” wins only above the locked line; “Less” wins only below it.
- Exact ties and voids: If either player's final fantasy score equals the locked line exactly, that pick is void and the complete lineup is refunded. If any pick is void for an operational, event, roster, data, or integrity reason, the complete entry amount is refunded unless a more favorable mandatory legal remedy applies.
- Locked contract summary: Before submission, ClutchKing displays the selected players, directions, locked lines, scoring basis, entry amount, multiplier, gross potential prize, and closing time. The gross potential prize includes the returned entry amount. These terms are recorded with the confirmed entry.
- Guaranteed prize: The displayed potential prize is fixed when the lineup is accepted and does not depend on participant count or total entry volume. No separate administrative fee is charged unless one is expressly included in the displayed price before submission.
- Cancellation: An eligible pending lineup may be cancelled for a full wallet refund within five minutes after submission, provided neither associated match has started. After five minutes, or as soon as either match starts, it is locked except for a void, correction, refund, or non-waivable legal right.
- Corrections: Settlement uses the locked scoring rules and official or approved event data. ClutchKing may correct data and resettle consistently when official statistics change or an obvious technical error is confirmed. Corrections cannot be used to change the locked line or multiplier after submission.
9. Confirmation, records, and errors
ClutchKing confirms accepted paid entries electronically and keeps a reproducible record of their material terms. Before submission you may correct selections and entry amount. If an entry is rejected, no funds should be reserved; if a reservation occurred because of a technical error, it must be released or reconciled.
10. Wallet, PIX, refunds, and prizes
Deposits, withdrawals, reservations, refunds, and prizes are recorded in the wallet ledger. PIX withdrawals may be limited to verified destinations belonging to the wallet holder and may undergo provider and administrative checks. A refund returns the applicable amount to the wallet; provider processing times may apply to movements outside ClutchKing. ClutchKing will not retain an undisclosed fee from a full refund.
11. Scoring, data, and service interruptions
Scoring may rely on official event data and third-party providers. Delays, corrections, walkovers, cancellations, and outages may require a temporary hold, resettlement, void, or refund under the published rules. Maintenance and security work may temporarily affect availability. ClutchKing must act transparently, consistently, and within applicable law when correcting an affected paid entry.
12. Consumer rights
Nothing in these Terms excludes or limits mandatory rights under the Brazilian Consumer Defense Code or other applicable law, including rights relating to clear information, contract access, correction of errors, refunds, service defects, statutory withdrawal where applicable, consumer authorities, and access to court. Product-specific cancellation windows do not waive a non-waivable statutory right.
13. Intellectual property and third parties
ClutchKing's software, interfaces, text, graphics, and marks belong to ClutchKing or its licensors. Third-party links and data sources remain subject to their own terms. Their inclusion does not imply endorsement, but ClutchKing remains responsible where applicable law so provides.
14. Suspension, termination, and appeal
ClutchKing may proportionately restrict an account for a documented legal, verification, security, payment, or integrity reason. Where appropriate, the user will receive the reason and an opportunity to appeal through support. Restrictions do not authorize confiscation of legitimate wallet funds or prizes. Open entries and balances must be settled, refunded, held, or released according to the applicable rules and law. A user may request account deactivation subject to necessary settlement, legal retention, and ongoing investigations.
15. Liability
ClutchKing does not promise uninterrupted or error-free operation. Any exclusion or limitation of liability applies only to the extent permitted by law and does not cover fraud, willful misconduct, gross negligence, personal injury, failure to provide mandatory consumer remedies, or other liability that cannot legally be excluded.
16. Changes to the service
ClutchKing may change or discontinue future features for operational, technical, integrity, business, or legal reasons. This does not permit reduction of a locked guaranteed prize or retroactive alteration of a confirmed paid entry. If ClutchKing cannot honor an affected paid experience, the applicable entry is refunded unless the published rule or law provides a more favorable remedy.
17. Complaints and disputes
Contacting support is optional and does not restrict access to Procon, Consumidor.gov.br, another competent consumer authority, or the courts. No compulsory arbitration, one-year private claim deadline, collective-action waiver, or blanket indemnity is imposed by these Terms. Brazilian law applies, with the competent forum determined by applicable procedural and consumer law, including protections for the consumer's domicile.
18. Privacy
Personal data is handled under the Privacy Policy and applicable data-protection law. Identity and financial data are used only for defined purposes such as eligibility, security, payments, compliance, support, and fraud prevention, subject to lawful retention and data-minimization requirements.
19. Severability and priority
If a provision is invalid, the remaining provisions continue where legally possible. A specific paid-experience rule supplements these Terms. If they conflict, the clearer or more favorable term for the consumer applies unless mandatory law requires otherwise.
20. Amendments
ClutchKing will identify the version and effective date of these Terms. Material amendments are announced before they apply and require express acceptance for new paid entries. Existing entries remain governed by the versions accepted at confirmation. Non-material corrections may take effect on publication without reducing rights or changing an existing paid entry.
